This document serves as both HailCore's Terms of Service and its End User License Agreement (EULA) for the App Store.
These Terms of Service ("Terms") govern your use of the HailCore mobile application (the "App"), operated by HailCore LLC ("we," "our," or "us"). By downloading, installing, or using HailCore, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use HailCore. By using the App you confirm that you meet this requirement and that you have the authority to agree to these Terms.
Subject to your compliance with these Terms, HailCore LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use one copy of the App for your personal, non-commercial purposes on any Apple-branded device you own or control, as permitted by the App Store's Usage Rules. All rights not expressly granted to you are reserved by HailCore LLC.
HailCore monitors NEXRAD weather radar and related data sources to identify storm cells that may be producing hail, and sends push notifications when a detected cell enters a radius you configure. HailCore is a supplementary, informational tool. It is not an official weather warning system and is not a substitute for alerts, watches, or warnings issued by the National Weather Service (NWS) or other government authorities. Always follow guidance from the NWS, local emergency management, and other official sources when making decisions about your safety.
HailCore offers an optional auto-renewing subscription ("HailCore Premium") that unlocks additional features. Subscriptions are sold and billed entirely through Apple's App Store, at the price displayed at the time of purchase.
Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription at any time in your Apple ID account settings; canceling does not refund any unused portion of an active period. Refunds are handled solely by Apple in accordance with Apple's refund policies — we do not have the ability to issue refunds directly.
HailCore is provided "as is" and "as available," without warranties of any kind, express or implied. Radar and weather data are inherently delayed, incomplete, or occasionally inaccurate due to factors outside our control, including gaps in radar coverage, data provider outages, and processing delays. We do not guarantee that the App will detect every hail-producing storm, that every alert reflects an actual hail threat, or that the App will be available, uninterrupted, or error-free at any given moment.
You should never rely on HailCore as your sole source of severe weather information, and you assume all risk associated with decisions made based on the App's alerts or data.
To the maximum extent permitted by law, HailCore LLC and its owners, employees, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of property, personal injury, or death, arising out of or related to your use of, or inability to use, the App — including but not limited to a missed alert, a false or delayed alert, or reliance on inaccurate data. This limitation applies regardless of the legal theory on which a claim is based, to the fullest extent permitted by applicable law.
You agree not to misuse the App, including attempting to interfere with its normal operation, reverse-engineer it beyond what is permitted by law, or use it for any unlawful purpose.
The App, including its design, code, and branding, is owned by HailCore LLC and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding beyond what is necessary to use the App as intended.
We may suspend or discontinue the App, or your access to it, at any time. You may stop using the App and delete it at any time. Provisions of these Terms that by their nature should survive termination (including disclaimers and limitation of liability) will continue to apply.
We may update these Terms from time to time. We will notify users of significant changes by updating the date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles.
If you obtained the App from Apple's App Store, the following additional terms apply, and in the event of any conflict, these terms control over the rest of this Agreement solely with respect to Apple:
Acknowledgment. This Agreement is between you and HailCore LLC only, not with Apple Inc. ("Apple"), and Apple is not responsible for the App or its content.
Maintenance and Support. HailCore LLC, not Apple, is solely responsible for providing any maintenance and support for the App. Apple has no obligation whatsoever to furnish any maintenance or support services.
Warranty. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are HailCore LLC's sole responsibility.
Product Claims. HailCore LLC, not Apple, is responsible for addressing any claims you or any third party may have relating to the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
Intellectual Property. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, HailCore LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
Legal Compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-Party Beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and that upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
